Privacy

Your Personal Data is information in our possession that relates directly or indirectly to you, to the extent that you can identified or identifiable from that information or from that and other information in our possession. The Personal Data that we collect may also include sensitive personal data which means any personal data consisting of information such as your physical or mental health or condition, your political opinions, religious beliefs or other beliefs of a similar nature, biometric data, the commission or alleged commission of any offence by yourself, or any other personal data as the Minister may determine.

We may obtain your Personal Data from yourself and from a variety of sources, including but not limited to: –

a.      Indirectly from agencies established by regulatory authorities, operators of registers or databases available to the industry, other external database suppliers, governmental departments, agencies or authorities, licensed credit reporting agencies, any party who has, does or will provide products or services to you and to whom you have granted consent, our commercial partners, or related persons or organizations from whom such information would be essential for the proper processing of the data within the purpose as stated herein; and

b.      Directly from you when you submit registration forms (either electronic or printed) relating to any of our products (new launches or property roadshows, showcases, exhibitions or any other promotional events) or services, register for or use any of our services on websites or mobile applications, use or purchase our services or products, enter into or make payments related to any transactions with us, interact with our customer service officers, participate in our contests, events and market surveys or research.

In addition to the above, we may use a variety of technologies, to automatically collect information about your activities on our website(s) and/or mobile application(s) (if any), such as web beacons, clear pixels or pixel tags, analytical tags, geo-location technologies and quick response (QR) code.

When you transact with S P Setia, we may collect a variety of your Personal Data, which may include amongst others your: –

a.      Name;

b.      National registration identity card / Passport number;

c.      Photocopy of National registration identity card / Passport;

d.      Gender;

e.      Marital status;

f.       Race and religious beliefs;

g.      Nationality;

h.      Postal address;

i.        Telephone number;

j.        Email address;

k.      Medical information;

l.        Fingerprint, photographs or other images;

m.     Salary range and Information relating to your Employment / name of Employer;

n.      Contact preference; and

o.      Credit card or bank account information and your credit history.

The list of Personal Data stated above is not exhaustive and may include other Personal Data depending on the nature of dealings or transaction with S P Setia.

Under certain circumstances, you may also be required to provide the personal data concerning other individuals for the purposes of your transaction with S P Setia and you hereby warrant and acknowledge that where you provided such data, you have obtained the consent of such individuals. If you are under the age of 18 years, you confirm that you have obtained your parent or guardian’s consent to provide your Personal Data to S P Setia.

The Personal Data (including sensitive personal data) collected from you in the course of your relationship with us is being, and will continue to be processed for the following purposes and any other incidental purposes, including but not limited to: –

a.        the delivery of notices, provision of services or products and the marketing of such services or products, whether present or future, to you;

b.        in order for you to enter into the necessary agreement and/or contract to purchase the products and/or properties from us (for real estate customers only), or to enter into tenancy, event management and other agreements or venue bookings with us;

c.        assisting with bank loan or housing mortgage and financing application;

d.        managing and servicing our relationship with you and providing you with better customer service, including user or customer relationship management procedures;

e.        those purposes specifically provided for in relation to any particular service or product offered by us;

f.         conducting marketing and client profiling activities in connection with our services and related products;

g.        conducting credit assessments and financial and other background checks of users as we may determine to be necessary or appropriate;

h.        our internal record keeping, reporting and audit purposes;

i.          collection of outstanding payments from clients;

j.          prevention of crime (including but not limited to fraud, money-laundering, bribery);

k.        meeting any legal or regulatory requirements relating to our provision of services and products and to make disclosure under the requirements of any applicable law, regulation, direction, court order, by-law, guideline, circular, code applicable to us or any member companies of our Group;

l.          purposes relating to any of the above (including but not limited to research, benchmarking and statistical analysis);

m.       enable us to send you information by e-mail, telecommunication means (telephone calls or text messages), social media or any other mode of communication as may be available from time to time, about products and services offered by selected third parties that we think may interest you but in doing so we maintain control over your Personal Data and we will not disclose your Personal Data to such third parties without your prior consent;

n.        vacant possession, keys handover, property/estate management, customer care and/or defect rectification works;

p.        post vacant possession services, such as club house services, security and customer loyalty programmes;

q.        provide access to our properties or facilities within our properties;

r.         enable us, our service providers, contractors or any applicable property owner to undertake property management, maintenance and/or repairs;

s.        maintaining and developing our business systems and infrastructure; and

t.         for data transfer to, and sharing with, other members of the S P Setia Group and/or third parties acting on our behalf, including those located outside Malaysia.

Please note that it is necessary for us to collect and process your Personal Data. If you do not provide us with your Personal Data, we will not be able to effectively provide services to you or process your Personal Data for any of the above purposes, if at all.

In processing your Personal Data for the above purposes, please note that we may transfer and further process your Personal Data outside of Malaysia. We will ensure the personal data transfer complies with the PDPA and the recipient jurisdiction affords similar levels of data protection safeguards as the PDPA.

During the course of your transaction and dealings with S P Setia, you may be requested to furnish your Personal Data from time to time. We may disclose your Personal Data to the following categories of persons (whether within or outside Malaysia): –

a.      any person to whom we are compelled or required to do so under law or in response to a competent or government agency;

b.      any related companies and subsidiaries of S P Setia, including those established in the future;

c.      joint management bodies/ management corporation, utility, electricity and sewerage companies or providers, our business partners, suppliers, vendors, surveyors and online affiliates that provide related services or products in connection with our business or to whom we outsource certain business operations;

d.      government agencies, regulatory authorities, bureaux or agencies established by regulatory authorities, statutory authorities and bodies, local authorities, tax and customs authorities and industry regulators;

e.      our auditors, consultants, accountants, lawyers or other financial or professional advisers;

f.      our sub-contractors or third party service or product providers as required or permitted by law or as we may determine to be necessary or appropriate, such as information processing, extending credit, fulfilling customer orders, delivering products to you, managing and enhancing customer data, providing customer service, assessing your interest in S P Setia products and services and conducting customer research or satisfaction surveys;

g.      third party property management companies/entities and security companies in respect of the management of property that customers have purchased;

h.      insurers, insurance intermediaries, benefit plan administrators, credit reporting agencies, banks and financial institutions;

i.      our appointed service providers in relation of our loyalty programs, for the purpose of delivery of gift redemption and services; and/or

j.      selected third parties outside the S P Setia Group for marketing research, statistical analysis and survey, direct marketing and general marketing and commercial campaign purposes aimed at promoting those services and products that may be of interest to you.

S P Setia takes the necessary precautions, both administrative and technical in accordance with our internal security policy to safeguard your Personal Data against any loss, theft, misuse, modification, unauthorized or incidental accessor disclosure, usage, alternation or destruction. Nevertheless, while we are committed to maintaining robust security standards, please note that no security measures can guarantee absolute protection.

S P Setia shall endeavour to make it easy for you to keep your information accurate, complete and up to date. We will retain your Personal Data for the period necessary in accordance with our internal retention policy to fulfill the many different purposes outlined in this Privacy Policy unless a longer retention period is permitted or required by law. We will take reasonable steps to ensure the Personal Data is destroyed or permanently deleted if it is no longer required.

Your Rights

You have the following rights under the PDPA in respect of your Personal Data that is held by us. You may: –

a.      check whether we hold or use your Personal Data and request access to such data;

b.      request that we correct any of your Personal Data that is inaccurate, incomplete or out-of-date;

c.      request that your Personal Data is retained by us only as long as necessary for the fulfilment of the purposes for which it was collected;

d.      request that we specify or explain its policies and procedures in relation to data and types of Personal Data handled by us;

e.      communicate to us your objection to the use of your Personal Data for marketing purposes whereupon we will not use your Personal Data for these purposes;

f.        withdraw, in full or in part, your consent given previously, in each case subject to any applicable legal restrictions, contractual conditions and a reasonable time period; and

g.      request that we transfer your Personal Data to another data controller, subject to technical feasibility and compatibility of format.

However, please note that your abovementioned rights under the PDPA are subject to our right to rely on any statutory exemptions and/or exceptions to collect, use and disclose your Personal Data.

Amendments to this Privacy Policy

S P Setia reserves the right to update and amend this policy from time to time. Any material changes will be posted on our website with the updated Privacy Policy. Your continued use of our services and the voluntary provision of your Personal Data after such changes have been posted will constitute your acceptance of, and consent to, the updated Privacy Policy.

Language

This Privacy Policy is issued in both English and Bahasa Malaysia pursuant to the requirements prescribed by Section 7(3) of the PDPA. In the event of any inconsistencies or discrepancies between the English version and the Bahasa Malaysia version, the English version shall prevail.
